Repeal of the 1972 European Communities Act

On 2nd October 2016 the former Secretary of State for Exiting the European Union David Davis announced that the Government planned to repeal the 1972 European Communities Act (ECA). The Act gives direct effect to all EU law and the introduction of a new Bill to repeal it will mean the Act ceases to apply from the day of exit.

On or around 14th November 2017, 70 MPs opposed repeal of the European Communities Act 1972.

During the first day of Committee Stage of the European Union (Withdrawal) Bill, MPs voted by an overwhelming majority in favour of passing Clause 1 of the Bill, which states, quite simply: “The European Communities Act 1972 is repealed on exit day.”
